Time to File a Second Amended Petition for an Adjusted

Alumax requests an extension of another 120 days
in which to file
an amended petition.
Alumax states that an extension
is needed due to ongoing
negotiations and exchanges with the Environmental Protection
Agency
(Agency)
.
Alumax contends that an extension will prevent
piecemeal amendments and allow Alumax to submit an amendment that
reflects the deficiencies cited by the Board and the negotiations
~ith
the Agency.
Alurnax also notes that there has been
a change
in
the Agency attorney assigned to this matter.
The Agency has
indicated that
it supports the filing of this motion.
Therefore,
Alumax is granted a 120 day extension from May
16,
1993 to file
a second amended petition.
The Board notes that
the second amended petition would now be due on or before
September 13,
1993 and not September 16,
1993 as stated in the
motion.
