ORDER OF THE BOARD
(by J. C. Marlin):
On
March
11,
1993,
the
Illinois
Environmental
Protection
Agency (Agency) filed a motion for extension of time to file Agency
recommendation.
In support of the motion, Charles
W.
Gunnarson,
the attorney for the Agency, filed an affidavit in support of this
motion for extension through April
2,
1993.
This is the Agency’s second motion for extension.
By order of
February 25, the Board granted an extension until March 12,
1993.
The Agency states that it received Forreston’s petition for
review
on January
25,
1993
and
that during
the
first
week
in
February the Agency contacted the attorney
for Forreston
in an
attempt to obtain more information.
The Agency also states that on
February
22,
1993,
Forreston’s
attorney was again contacted
in
order to request more information.
At that time, the attorney for
Forreston said the information would be forthcoming.
The Agency states that it contacted Forreston again on March
9,
and was told Forreston’s consulting engineer had been studying
the question and would be submitting
a written response to the
Agency shortly.
The Agency’s motion for extension is granted through April
2,
1993.
The Board notes, however, that the Board does not intend to
grant
further
extensions
absent
a waiver
of
the
May
22,
1993
decision deadline.
IT IS SO ORDERED.
