ORDER OF THE BOARD

This case is before the Board on a March 23,
1993 motion to
reconsider,
filed by respondent Kibler Development Corporation
(Kibler).
Kibler seeks reconsideration of the Board’s February
25,
1993 order denying its motion to dismiss the petition for
review.
Petitioners Concerned Citizens of Williamson County, and
R.S. Blakely and Max Stucker, as individual members of Concerned
Citizens of Williamson County (collectively,
Citizens),
filed a
response in opposition on April
2,
1993.
Kibler asks that the Board reconsider its previous order
denying its motion to dismiss Citizens’ petition for review.
The
Board denied that motion because the record in this proceeding
had not yet been filed,
so that there was no way to review
Kibler’s contention that the alleged flaws raised by Citizens
were belied by the record.
In the instant motion to reconsider,
Kibler notes that the record has now been filed and can be
“readily examined” to determine whether the original motion to
dismiss has merit.’
The motion to reconsider is denied.
Kibler has not cited to
