ORDER OF THE BOARD
(by R. C. Flemal):
On February 4,
1992,
the Board ordered the parties to file
status reports to be received on or before March 16,
1993.
The
petitioner filed its status report on March 16,
1993.
Respondent
filed its status report on March 19,
1993.
The parties state that respondent continues to review the
work plan for the column leach test which addresses alleged soil
contamination around certain of petitioner’s tanks.
Respondent
states that it expects to complete its review of the column leach
test by April
30,
1993,
and that after that date the parties
would be in a better position to determine if the matter can be
concluded without a hearing.
Petitioner reports that respondent
has now approved the closure certification statements for five of
the six remaining RCRA storage tanks.
Petitioner states that it
remains hopeful that the issues will be resolved, and grants a
waiver of the decision deadline until March 31,
1994 to
accommodate amicable resolution.
The parties are ordered to provide written status reports to
be received by the Board no later than May 21,
1993.
