    ORDER OF THE BOARD
    (by 3. Anderson):
    On April
    1,
    1993,
    spraying Systems Company
    (SSC)
    and the
    Illinois Environmental Protection Agency (Agency)
    filed a joint
    status report.
    The filing comes in response to a February 4,
    1993 Board order directing the parties to file a status report by
    April
    1,
    1993.
    In their status report, the parties state that they met on
    June 22,
    1992, to discuss the Agency’s concerns regarding SSC’s
    closure plan and further evaluation of the site.
    On August
    3,
    1992,
    SSC submitted a proposed RCRA closure work plan for
    additional subsurface investigation to the Agency.
    It was
    expected that the proposed work could be completed in three and
    one-half months after the Agency’s approval.
    The Agency agreed
    to review the work plan and provide comments to SSC within 30 to
    45 days.
    On April
    1,
    1993,
    the Agency reviewed the work plan and
    provided its comments to SSC.
    SSC asserts that it will review
    the Agency’s comments and seek to schedule a meeting with the
    Agency within two weeks.
    SSC estimates that it will take at
    least four months after the parties agree on the work plan to
    actually complete the work plan.
    SSC
    anticipates that an
    agreement on the work plan will not be reached before the end of
    April.
    In light of the above,
    the parties do not expect this
    matter to be settled prior to October,
    1993.
    SSC states that it
    is willing, however, to waive the Board’s decision deadline from
    September 30,
    1993 to December 31,
    1993.
    In light of the above as well as the parties’ assertion that
    they are “optimistic about the prospects for settlement”, the
    Board directs the parties to file an updated status report to be
    received by the Board no later than July 19,
    1993.
    The Board
    also construes SSC’s willingness to waive the Board’s decision
    deadline as an actually waiver of the decision deadline to
    December 31,
    1993.
