    ORDER OF THE BOARD

    By order of April
    8,
    1993, the Board directed that all
    hearings be completed in this matter by July
    16,
    1993.
    Hearing
    is currently scheduled for July 16.
    On July
    7,
    1993,
    Berkshire filed an agreed motion to
    continue hearing through October 15,
    1993.
    The motion recites
    that:
    The
    parties
    have been pursuing a settlement
    with respect to the matters alleged in the
    complaint for a number of months.
    Substantially all issues have been resolved
    and the parties are discussing final
    settlement terms.
    A draft of an agreed order
    that would resolve all issues has been
    exchanged by the parties and all but a few
    issues have been resolved.
    Counsel for complainant has represented to
    counsel for Berkshire
    that the most recent
    draft of the agreed order will be forwarded
    to Berkshire
    this week.
    (Berkshire
    believes that further revisions will be
    necessary before final agreement is reached.
    Even
    if final agreement is reached quickly,
    the time required for complainant and its
    counsel to review and approve the agreed
    order will delay settlement past the hearing
    date.
    The motion for continuance
    is hereby granted.
    The parties
    are directed to file
    a status report on or before October 15,
    1993,
    in the event this case has not been closed by that time.
