Dismissal Order

ORDER OF THE BOARD (by B. Forcade):

Section 22.4(d) of the Environmental Protection Act requires

the Board to adopt regulations that are “identical in substance”

with TJSEPA underground storage tank rules implementing sections

3001, 3002, 3003, 3004 and 3005 of the Resource Conservation and

Recovery Act of 1976

(P.L.

94—550). The term “identical in

substance” has been defined in Section 7.2 of the Act.

Accordingly, the Board reserved this docket for USEPA amendments

during the period from January 1 through June 30, 1993. No

federal UST amendments occurred during this update period.

For the foregoing reason, the Board hereby dismisses this

docket.
