ORDER OF THE BOARD

On May 3,
1993,
The Grigoleit Company (Grigoleit)
filed a
status report and a motion to continue.
On May
3,
1993, the
Illinois Environmental Protection Agency
(Agency)
filed its
status report in this matter.
The status reports come in
response to an April
8,
1993 Board order directing the parties to
file status reports with the Board by May
3,
1993.
In its motion, Grigoleit requests the Board to continue this
matter and require the parties to file a status report on or
before June 4,
1993.
In support of its request, Grigoleit states
that it and the Agency have been engaged in settlement
negotiations which would,
if successful, culminate in the
settlement of this case as well as the following three cases:
PCB 90-135, The Gricioleit Company v. Illinois Environmental
Protection Agency
PCB 91—157, People of the State of Illinois v.
The GricToleit Company and PCB 92-23, The Grigoleit Company v.
Illinois Environmental Protection Agency.
Grigoleit adds that the parties met on April 29,
1993.
At
such time, Grigoleit provided the Agency with confidential
information in order to clarify certain information that had been
previously supplied to the Agency.
It is Grigoleit’s
understanding that the Agency will evaluate the information and
respond to Grigoleit with any question it might have.
Grigoleit
adds that
it believes that,
as a result of the meeting, the
Agency should have a clearer understanding of Grigoleit’s
operations so that any possible settlement should proceed
quickly.
In its report, the Agency states that, at the April 29,
1993
meeting,
it requested a week to ten days to analyze the
internally discuss the information submitted to the Agency.
The
Agency also recommended the submittal of additional related
information regarding a specific emission unit at Grigoleit’s
facility to help clarify the nature of that emission source.

In light of the above, the Board hereby grants Grigoleit’s
motion to continue.
The parties are directed to file status
reports in this matter.
Such status reports are to be received
by the Board no later than June
4,
1993.
The Board notes,
however, that this is the parties’
fifth motion to continue this
matter for the purpose of settlement negotiations.
We caution
the parties that it will not continue this matter indefinitely
and that it expects the parties to expeditiously pursue
a
resolution of this case.
