This matter comes before the Board on Reynolds’ September 4,
1991, petition for adjusted standard.
The Board accepted this
matter for hearing on January 23,
1992, but delayed assigning a
hearing officer.
This delay was necessary because the petition
could result in a revision to the State Implementation Plan
(SIP).
Before a revision to the SIP can be accepted, the USEPA
must first revise the Federal Implementation Plan (FIP).
Reynolds has petitioned the USEPA for the revision of the FIP and
is awaiting the decision.
On January 28,
1993, Reynolds filed a
status report pursuant to a October
1,
1992 Board order.
In its most recent report, Reynolds states that:
On June 23,
1992, the United states Environmental
Protection Agency
(“USEPA”) published a notice in the
Federal Register staying the effectiveness of 40 CFR
52.741(x) and
(y)
as they apply to Reynolds to allow
the USEPA to reconsider the applicability of the rules
to Reynolds.
The notice stated that USEPA is
proceeding expeditiously with the reconsideration.
The
USEPA regional office expects to send a proposal to
USEPA Headquarters by the end of January.
The Illinois
Environmental Protection Agency concurs with this
status report.
Given that the USEPA has stayed the effectiveness of the
Federal regulations as they apply to Reynolds pending
reconsideration, the Board hereby stays the proceedings in this
matter until Nay

1993, at which time the parties are directed
to file a status report with the Board.
