ORDER OF THE BOARD (by J. Anderson):
On February 3, 1993, the City of Chester (Chester) filed a
petition for variance from the 35 Ill. Adin. Code 602.106(a),
entitled “Restricted Status”, as that rule relates to the limit
for total trihalomethanes specified in 35 111. Adm. Code
611.310(c). On that same date, Chester also filed a “motion for
expedited hearing.”
In its motion, Chester asserts that the Illinois
Environmental Protection Agency (Agency) has informed its counsel
that it plans to submit a recommendation in less than thirty
days. Chester adds that “this information should allow the Board
to make its decision at the next scheduled meeting.”
In its variance petition, Chester waived hearing in this
matter. Accordingly, the Board construes Chester’s “motion for
expedited hearing” as a motion for expedited decision. The
Board, however, hereby denies Chester’s request for an expedited
decision in that Chester has not asserted any special
circumstances or hardship which would distinguish it from other
similarly situated petitioners and, in turn, justify an expedited
decision.
