ORDER OF THE BOARD (by R. C. Flenial):

On June 21, 1993, Earl Luster Trust (Trust) filed a petition

for review of an Underground Storage Tank Reimbursement

Determination. This matter is accepted for hearing.

This petition is filed pending the outcome of an appeal of

an administrative order issued by the Office of the State Fire

Marshal. (Pet. at 3.) Trust contends that the result of the

appeal will determine if the Illinois Environmental Protection

Agency’s decision at issue was in error. (Pet. at 3—4.) Trust

also filed an open waiver of the decision deadline.

The parties are ordered to file status reports to keep the

Board informed of any change in the status of this case. The

parties shall file a status report with the Board on or before

December 30, 1993. Subsequent status reports should be filed

every six months thereafter or sooner if circumstances warrant.

Based on the status reports the Board will set this matter for

hearing or take other appropriate action.
