BOARD

On June 23,
1993, Reichhold Chemicals,
Inc.
(Reichhold)
filed a status report and a motion to extend stay.
Reichhold
also filed a waiver of the decision deadline.
The status report states that a hearing date has not been
set in a related proceeding before the Office of the State Fire
Marshal
(OSFM).
Reichhold notes that a meaningful hearing before
the Board cannot be held until the OSFM addresses the
registration appeal.
Therefore, Reichhold requests a 90-day
extension of the stay, which expired on June 25,
1993.
Reichhold states that it “waives the statutory decision
deadline for an additional 120 days up to and including January
25,
1994 (previously October 25,
1993).”

The Board
notes that January 25,
1994 is only 92 days from the current
statutory deadline of October 25,
1993.
Since it is not evident
if the waiver was intended to be for 120 days or until January
25,
1994, the Board will accept the waiver for the earlier of the
two times specified.
Therefore, the new decision deadline is
January 25,
1994.
The Board grants the motion for a 90 day extension of the
stay.
This matter is stayed until September 24,
1993.
The Board
also notes that given the present decision deadline, this matter
must be set for hearing at the time the stay expires.
The parties are instructed to file additional status reports
to be received by the Board on or before September 17,
1993.
