ORDER OF THE BOARD (by G. T. Girard):
On February 1, 1993, the Board received a status report
filed by the petitioner. The status report indicates that the
petitioner has spoken with the Illinois Environmental Protection
Agency (Agency) and the Agency intends to file its recommendation
on or before March 1. The petitioner indicates that it has no
objection to this schedule.
On February 3, 1993, the Board received a status report from
the Agency. The Agency i~ndicatedthat it has reviewed the filing
by petitioner and will file its recommendation within 30 days.
Therefore, the Board directs the Agency to file its
recommendation to be received by the Board not later than March
3, 1993.
This petition for variance was filed on June 15, 1992 and
the matter was set for hearing. In the Board’s order setting the
matter for hearing the Board asked the Agency to specifically
address the issue as to whether this variance was a request for a
RCRA variance. In response to the Board’s inquiry, the Agency
states that it “is uncertain about the answer to this question
and asks the Board for direction on whether the Agency should
treat this variance as a RCRA variance”. The Board will continue
to treat this as a RCRA variance request.
