ORDER OF THE BOARD (by B. Forcade):
On August 18, 1993, the Environmental Protection Agency
(Agency) filed a “Motion for Extension of Time to File Agency
Recommendation.” The Agency states that a meeting is planned
with Atlanta Meadows, Ltd. and R.O.C. Properties, Inc.,
(Atlanta). The Agency contends that the information derived from
this meeting will be useful in preparing the Agency’s
recommendation. Therefore, the Agency requests an extension
until September 17, 1993, to file its recommendation.
On August 20, 1993, Atlanta filed a “Response to Motion for
Extension.” Atlanta indicates that it has no objection to the
extension and is in agreement with statements made by the Agency
in its motion. Atlanta also filed a waiver of the decision
deadline through December 31, 1993.
The Agency is to file its recommendation on a petition for
variance within 30 days of the filing of the petition or any
amendment to the petition. (35 Ill. Adm. Code 104.180.) Atlanta
filed its amended petition on July 19, 1993. Accordingly, the
Agency’s recommendation was due to be filed on or before August
18, 1993.
The Board grants the Agency’s motion and the Agency
recommendation is to be filed on or before September 17, 1993.
However, the Board notes that if a waiver of the decision
deadline had not been filed by Atlanta, the Board would not have
granted the Agency’s motion.
