    Petitioner,
    v.
    )
    PCB 93-1
    )
    (Permit Appeal)
    ILLINOIS ENVIRONMENTAL
    PROTECTION AGENCY,
    Respondent.
    ORDER OF THE BOARD (by J. Anderson):
    On September 15, 1993, Pekin filed an agreed motion for a
    60-day extension of the briefing schedule in each of two permit
    appeals, PCB 92—212 and PCB 93—1. In each case, the briefing
    schedule had been previously extended 60 days by Board order of
    August 5, 1993. The instant requests were accompanied by 120 day
    waivers of the decision deadlines to March 31, 1994.
    Pekin states that on August 26, 1993, representatives of
    petitioner, the intended purchaser of the landfill, respondent,
    and the Office of the Attorney General met in Chicago as part of
    ongoing discussions aimed at settlement of all pending issues
    related to petitioner, including this matter. The
    representatives at the meeting concluded that settlement is
    possible if sale of the landfill to the intended purchaser is
    consummated on or before September 26, 1993. The motion states
    that negotiations towards sale of the landfill are progressing,
    the petitioner in good faith anticipates that the sale will be
    completed by September 26, 1993, and that this matter will be
    resolved by agreement of the parties. Accordingly, petitioner
    and the Agency desire to again delay briefing of the issues
    presented in this appeal.
    The motion for extension is granted. Petitioner’s closing
    brief is now due on or before November 13, 1993.
    IT IS SO ORDERED.
