ORDER OF THE BOARD (by B. Forcade):
On August 5, 1993, the Illinois Environmental Protection
Agency (Agency) filed its fourth Motion to Extend Time to File
Agency Record. The Board had previously granted an extension for
the filing of the record until August 23, 1993. The Agency
requests an additional 120 day extension. On August 6, 1993, the
petitioner filed its fourth waiver of the decision deadline,
extending the deadline until March 18, 1994.
The Agency notes that it has discussed the issues raised in
the petition with the petitioner and believes that the issues
will be moot due to a pending rule making related to 35 Ill. Adm.
Code 218. The Board anticipates the adoption of the pending
rule making, R93-9, Omnibus Cleanup of the Volatile Organic
Material RACT Rules Applicable to Ozone Nonattainment Areas:
Amendments to 35 Ill. Adm. Code Parts 203, 211, 218 and 219, in
the next several weeks.
The Board grants the Agency’s motion and the record is now
due to be filed on or before December 21, 1993. The Board also
orders the parties to file status reports by November 19, 1993,
which is 120 days prior to the decision deadline.
