    ORDER OF THE BOARD (by C.A. Manning):
    This matter is before the Board on a stipulation of
    settlement, jointly filed on April 21, 1994 by petitioner, Park
    District of Highland Park, (“District”) and respondent, the
    Office of the Illinois State Fire Marshal (“OSFM”). The joint
    stipulation of settlement, signed by all the parties, provides
    that the parties stipulate and agree to dismiss the action and
    the petitioner is to file with the respondent the following:
    1. A new Eligibility and Deductibility Application
    form with respect to removal of two, 3,000-gallon
    tanks that were located in Central Park, pursuant
    to Section 57.9(c) of the Illinois Environmental
    Protection Act (415 ILCS 5/57.9(c)), to amend the
    Eligibility and Deductibility Application dated
    November 12, 1993;
    2. A new Amended Notification for Underground Storage
    Tanks form for the above—described tanks, to amend
    the Notification dated April 16, 1986 and Amended
    Notification dated January 22, 1993 and October 8,
    1993;
    3. A new Amended UST Information Sheet for the above-
    described tanks, to amend the sheet attached as an
    exhibit to the Eligibility and Deductibility
    Application dated November 12, 1993.
    4. A cover letter indicating that the above—listed filings
    are resubxnittals and that the changes stated in said
    filings reflect that the estimated date the tanks were
    last used or out of service was 1975.
    While
    the Board makes no findings of fact or conclusions of

    law, based on the parties assurances and affirmations, we dismiss
    this matter and hereby direct the parties to effectuate their
    agreement. The docket in this matter is hereby closed.
