(C.A. Manning):

This matter is before the Board pursuant to Robert Miehie

(“Miehie”)

and Chicago Bridge and Iron Company’s (“CDI”) joint

stipulation filed April 15,

1994.

The stipulation states that

the parties are in agreement as to CDI withdrawing its motion to

dismiss or compel discovery which was filed with the Board on

March 29,

1994, and to Miehle withdrawing his motion for costs

filed on April 4,

1994.

Accordingly, as there are no motions pending before the

Board, this case may resume its discovery and hearing schedule.

IT IS SO ORDERED.
