OF THE
BOARD
(C.A. Manning):
This matter comes before the Board pursuant to an Illinois
Environmental Protection Agency Motion for Extension of Time to
File Agency Recommendation, filed November 2, 1993. Counsel for
the Agency represents in a motion supported by affidavit, that the
Agency is currently reviewing the requested variance petition and
that discussion regarding the variance and a possible adjusted
standard, are ongoing. The motion and affidavit indicate that,
while the recommendation was due October 27, 1993, an extension
until January 31, 1994 would allow the parties sufficient time to
resolve this matter. The affidavit also states that counsel for
the Ensign-BickfOrd Company intends to file a waiver of the
statutory decision deadline and that Ensign-Bickford has no
objection to the filing of the instant motion.
On November 9, 1993, the Board received a statutory deadline
waiver from the Ensign-Bickford Company until April 30, 1994. As
such, the Board hereby grants the Agency an extension of time until
on or before January 31, 1994 to file the Agency recommendation in
this matter, unless this case is otherwise resolved or dismissed.
