ORDER OF THE BOARD

On November 15,
1993,
Pekin filed an agreed motion for a 60-
day extension of the briefing schedule in each of two permit
appeals, PCB 92-212 and PCB 93-1.
In each cage, the briefing
schedule had been twice previously extended 60 days by Board
orders of August
5,
1993 and September 23,
1993.
The instant
requests were accompanied by 120 day waivers of the decision
deadlines to July 29,
1994.
Pekin states that since the Board’s order of September 23,
1993, which granted petitioner until November 13,
1993, to file
its brief in each case, the parties have reached agreement on all
substantive issues, including resolution of the issues raised in
the two permit appeals.
The only outstanding matter is the
reformatting of the settlement proposal, which counsel for
petitioner drafted in agreement form and which the Office. of the
Attorney General is redrafting in consent order form.
Pekin in
good faith anticipates that the consent order will be signed
before Thanksgiving and will result in dismissal of the two
permit appeals currently pending before the Board.
Pekin states
that the Agency has no objection to the Board granting a further
extension of the briefing schedule in this matter.
The motion for extension is granted.
Petitioner’s closing
brief is now due on or before January 12,
1994.
