On January 14,
1994, the Agency filed identical motions in
AS 93—4 and AS 93—5.
These are motions to withdraw and
substitute appearances, and for an extension of time in which to
file an Agency response.
The motion recites that petitioner has
no objection,
and will not file a response, to these motions.
The Agency’s response in these cases was due to be filed on
or before September 25,
1993.
The motions state that the
attorney originally assigned these cases has left the employ of
the Agency.
However, the Agency has conducted a technical
meeting with the petitioner,
and has repeatedly consulted by
telephone with petitioners experts and attorney.
The Agency has
sent a draft response to Petitioner and is awaiting a reply.
The
Agency and Petitioner are scheduled to meet and discuss their
respective positions on January 19,
1994.
The Agency expects to
be able to submit a response to the Board promptly after January
19,
1994.
The Agency’s motions are granted.
The Agency response is
now due to be filed on or before February 18,
1994.
