    ORDER OF THE BOARD
    (by C.A. Manning):
    This matter is before the Board pursuant to a motion to stay
    the instant proceedings filed by the petitioner,
    Quantum Chemical
    Corporation,
    USI
    Division
    on
    November
    24,
    1993.
    The
    motion
    requests that this adjusted standard proceeding be stayed for 90
    days so that Quantum Chemical may confer with counsels from the
    Environmental Protection Agency to determine whether the matter can
    be resolved in the context of Pea 93—173,
    a NPDES permit appeal
    which is also currently pending before the Board.
    Having received no response to the motion from the Agency, we
    hereby grant the motion to stay until February 17,
    1994.
    Quantum
    Chemical is directed to file a status report on or before February
    1, 1994 indicating the status of any on-going negotiations.
    If the
    negotiations result in the parties agreeing to pursue PCB 93-173
    rather than AS 93—1, Quantum may instead file a motion to withdraw
    the petition for an adjusted standard.
    Quantum is reminded that with regard to PCB 93-173, wherein
    Quantum has filed
    a waiver of the statutory deadline until June,
    1994, if that matter is not resolved by the expiration of the stay,
    in light of Quantum’s attempt to incorporate the relief requested
    under
    AS
    93-1,
    an additional waiver
    of
    the
    statutory decision
    deadline should be filed in conjunction with the February status
    report
    in
    AS
    93-1.
    The Board
    requires
    120
    days
    in
    which
    to
    schedule,
    receive
    and review
    the hearing
    transcript
    and
    fully
    deliberate on the matter.
    Under such time constraints, the Board
    will be required to set
    PCB 93-173 for hearing in February without
    an additional waiver of the statutory deadline.
