ILLINOIS POLLUTION CONTROL BOARD
    March 31, 1994
    IN THE MATTER OF:
    )
    R94—3
    DEFINITION OF VON UPDATE,
    )
    (Identical in Substance Rules)
    USEPA REGULATIONS (JULY 1
    )
    THROUGH DECEMBER 31, 1994)
    Proposed rule.
    Dismissal order.
    ORDER OF THE BOARD (by R.C. Flemal):
    Section 9.1(e) of the Environmental Protection Act (Act)
    requires the Board to adopt regulations which are “identical in
    substance” to exemptions from the definition of “volatile organic
    material” those compounds that U.S. EPA has found to be exempted
    from regulation under state implementation plans for ozone due to
    negligible photochemical reactivity. U.S. EPA has codified these
    exemptions as part of its definition at 40 CFR 51.100(s).
    Accordingly, the Board reserved this docket for USEPA amendments
    during the period from July 1 through December 31, 1993.
    However, USEPA did not amend its definition or exemptions during
    this period.
    For the foregoing reason, the Board hereby dismisses this
    proceeding.
    IT IS SO ORDERED.
    I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control
    Board, do hereby certify that the above order was adopted on the
    ~i/-~-~
    day of _________________________, 1994, by a vote of
