ORDER OF THE BOARD

(by H. McFawn):

Section 22.4(d)

of the Environmental Protection Act

(Act)

requires the Board to adopt regulations which are “identical in

substance” to underground storage tank

(UST) regulations

promulgated by U.S. EPA pursuant to Section 9003 of RCRA to

iinplenient Subtitle I of RCRA, with certain limitations.

U.S. EPA

has codified its UST regulations at 40 CFR 281 through 283

The

Board reserved this docket for any UST amendments adopted by U.S.

EPA between July 1 and December 31, 1993.

However, USEPA did not

amend its UST regulations during this period in any way that

would require Board action.

For the foregoing reason, the Board hereby dismisses this

docket.
