ORDER OF THE BOARD (by G.T. Girard):

Section 9.1(e) of the Environmental Protection Act (Act) (415 ILCS 5/9.1(e) (1998))

requires the Board to adopt regulations which are “identical in substance,” as defined at Section

7.2 of the Act. 415 ILCS 5/7.2 (1998). Exemptions or deletion of exemptions from the

definition of “volatile organic material” (VOM) are usually incorporated in Illinois regulations

through “identical in substance” rulemakings. VOM are those compounds that the United

States Environmental Protection Agency (USEPA) has found to be exempted from regulation

under state implementation plans for ozone due to negligible photochemical reactivity. The

USEPA has codified these exemptions as part of its definitions at 40 C.F.R. 51.100(s).

Accordingly, the Board reserved this docket for the USEPA amendments during the period

from July 1, 1999, through December 31, 1999.

During the period from July 1, 1999, through December 31, 1999, the USEPA did not

amend its definition of VOM. Therefore, the Board hereby dismisses this docket.
