ORDER OF THE BOARD (by E.Z. Kezelis):
On December 27, 1999, Terrence Graf, the designated lead complainant, filed
correspondence with the Board in which he indicated a desire to voluntarily dismiss the
complaint. For purposes of this order, the December 27, 1999 correspondence will be treated
as a motion to dismiss. By hearing officer order of January 11, 2000, the other named
complainants were directed to contact the hearing officer on or before January 20, 2000, if they
disagreed with dismissal and wished to proceed with litigation. The hearing officer was not
contacted by any of the complainants. The respondents have not responded to the motion.
Accordingly, the motion to dismiss is granted and this docket is hereby closed.
IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the 3rd day of February 2000 by a vote of 5-0.
Dorothy M. Gunn, Clerk
Illinois Pollution Control Board
