ORDER OF THE BOARD
(by J. Theodore Meyer):
This matter is before the Board on a January 18,
1994 status
report filed by petitioner Moline/Dutchway Dry Cleaners
(Dutchway).
Dutchway states that it has retained a consulting
engineer to review documents from the Illinois Environmental
Protection Agency
(Agency), that the engineer recently received a
response to his request for Agency documents, and that Dutchway’s
counsel believes, based on a preliminary review of those
documents,
that there may be a basis for proceeding with this
appeal.
Dutchway states that it needs additional time to
continue consultations with its engineer and to pursue further
negotiations with the Agency.
The Board accepts Dutchway’s status report.
Dutchway is
directed to file an updated status report with the Board
rio
later
than April
15,
1994.
That report shall include a projection as
to the timing of further proceedings before the Board.
IT IS SO ORDERED.
