This matter is before the Board on its own motion. On

September 23, 1993, petitioner Kewanee Community Unit School

District No. 229 (Kewanee) filed a waiver of the Board’s decision

deadline. A decision is now due on June 30, 1994. Kewanee

reiterates that it has reached a settlement with the Illinois

Environmental Protection Agency (Agency), and that the settlement

is currently being implemented. However, Kewanee is still

awaiting payment by the Agency as a final portion of the

settlement. Kewanee states that because there may be no need for

a hearing in this matter, the parties ask that hearing be

postponed until the settlement process is finalized, or until the

need to schedule a hearing consistent with the new decision

deadline.

Kewanee is directed to file a status report with the Board

by February 4, 1994.
