This matter is before the Board on petitioner Clayton
Chemical’s status report, received on November 3,
1993.
Clayton
Chemical states that it has submitted a new Part B application to
the Illinois Environmental Protection Agency (Agency) on or about
October 5,
1993, and that Clayton Chemical is in consultation
with the Agency on whether the new application may settle the
disputes between the parties.’
The Board accepts Clayton Chemical’s status report.
Clayton
Chemical is directed to file an updated status report no later
than February 4,
1994.

the instant status report, Clayton Chemical contends that it did
file a September 1 status report, and attaches a copy of that

finds no indication that we received that September 1 report.
