ORDER OF THE BOARD (by G. T. Girard):
On June 8, 1994, the Village of Sauget filed a petition for
permit review regarding its two (2) wastewater treatment plants,
the American Bottoms Regional Wastewater Treatment Plant and the
Physical Chemical Plant, both located in St. Clair County. The
Petition seeks review of two (2) NPDES general storm water
discharge permits. The permits were issued under the same permit
number for both facilities.
The Village of Sauget asserts that the NPDES storm water
permits were not necessary for either plant because both
facilities are owned by a municipality which has a population of
less that 100,000.
(~
Section 402(p) of the Clean Water Act,
33 U.S.C. S1342(p), codified at 40 C.F.R. 122.26).
It has been the Board’s long standing practice to require
that separate petitions be filed for appeals of each of several
permits; each permit involves a separate Agency permitting
decision, permitting file, and deadlines for Board and Agency
actions pursuant to Sections 39 and 40 of the Act. The Village
of Sauget is accordingly directed to file an amended petition in
this docket number (PCB 94-175) and a new petition in another
docket. Each filing must challenge only one permit, which is to
be identified by number in the petition. The new petition must
be accompanied by the $75.00 filing fee required by Section 7.5
of the Act. The filing of the amended and new petition will
restart the Board’s decision timeclock. However, the Board will
look to the June 8, 1994 filing date of the initial petition in
determining issues of timeliness of appeal.
Upon motion, the Board will consider consolidating these two
dockets for hearing.
Failure to file the separate amended and new petition
required by this order within 45 days of the date of this order
may subject this matter to dismissal.
