    ORDER OF THE BOARD (by M. McFawn):
    On November 24, 1999, the Illinois Environmental Protection Agency (Agency) and petitioner
    filed a request for a 90-day extension of the 35-day appeal period for petitioner’s facility located at the
    Des Plaines Oasis on I-90 south bound. By order of December 2, 1999, the Board docketed the
    matter as PCB 00-89 and granted the request for extension. On January 18, 2000, the Board received
    petitioner’s petition for review in PCB 00-89. The Board accepts PCB 00-89 for hearing.
    On July 23, 1998, and January 7, 1999, the Board consolidated fourteen similar underground
    storage tank refund appeal cases brought by petitioner. On its own motion, the Board hereby
    consolidates petition PCB 00-89 with the previously consolidated cases. Additionally, the Board
    consolidates PCB 00-51 and PCB 00-52, both similar underground storage tank refund appeal cases,
    with the previously consolidated cases. The facts and issues of PCB 00-51, PCB 00-52, and PCB 00-
    89 are substantially similar to the previously consolidated cases. Today’s caption reflects the latest
    consolidation.
    As with the other cases in this consolidated matter, the Board notes that Board rules require the
    Agency to file the entire Agency record of the site classification work plan and budget amendment. See
    35 Ill. Adm. Code 105.102. Hearing must be scheduled and completed in a timely manner, pursuant to
    the applicable statutory decision deadline, or the decision deadline as extended by a waiver. See 35 Ill.
    Adm. Code 101.105.
    Absent any future waivers of the decision deadline, the statutory decision deadline is
    June 24, 2000; the Board meeting immediately preceding the decision deadline is June 22, 2000.
