Section 22.4(a)

of the Act

(as amended by P.A. 88—496 and

88-512) requires the Board to adopt regulations implementing

Subtitle D of the Resource Conservation and Recovery Act as

“identical in substance”.

Accordingly, the Board reserved this

docket for USEPA amendments during the period from January

1

through June 30,

1993.

During that time period, USEPA only amended its landfill

regulations at 58 Fed. Reg.

9248

(Feb.

19,

1993).

Those

amendments revised 40 CFR 257 which accommodates a sludge

management program that does not exist in Illinois.

The

amendments affected landfill operations only to the extent that

they state the interplay of two governing sets of regulations:

the RCRA Subtitle D rules

(40 CFR 256—258)

and the federal sludge

management rules

(40 CFR 503).

Therefore no action is necessary

in this docket and the Board hereby dismisses the proceeding.
