In a January 14, 1994 status report,. A
•
B. Dick Company (A. B.
Dick) notified the Board that the parties continue to negotiate a
settlement in this matter and in a related
case,
A.B. Dick v.
IEPA, PCB 92-209. Pursuant to our order of January 20, 1994,
A.B. Dick filed an additional status report on June 15, 1994.
A.B. Dick reports that they have taken additional samples and
performed additional technical studies and that technical
representatives from both parties have met and continue to meet
to resolve technical issues.
A B.
Dick also indicates the
parties have tentatively scheduled a meeting for late July to
negotiate a settlement once an agreement is reached on the
technical issues.
A.B. Dick remains confident that a settlement will be
reached and request this matter not be set for hearing until the
parties have exhausted all settlement opportunities. We hereby
accept the status report filed by A.B. Dick, and direct the
parties to file an additional status report on or before August
25, 1994. This case has been waived until January 1, 1995. If
the parties intend to pursue settlement beyond the next status
report due date, a statutory decision deadline waiver must be
filed by August 25, 1994 or this case will be set for hearing.
