ORDER OF THE BOARD

On December 29,
1993, the complainant moved the B!oard to
reconsider
its default order entered November
4,
1993.
The
motion
states
that
the
parties have engaged in negotiations and
reached
a
settlement,
and
that
“refusal to adopt the stipulation
defeats the goals of the Act (which is
compliance...not punitive
damages”.
In the proposed settlement, the complainant would
withdraw one count of the administration citation
(AC),
the
respondent would admit to the other two alleged violations, and
the respondent would accordingly pay a $1,000 fine rather
than
the $1,500 fine assessed by
the
Board
on
November
4 based on
the
original
AC.
Complainant’s motion for reconsideration is untimely filed
outside the 35 day period specified in 35 Ill.
Adm. Code 101.246,
and the motion does not state why the Board was not earlier
notified of the pendency of settlement negotiations.
However, as
the Board has previously acknowledged, the “law favors
settlements”, People v. Kershaw, PCB 92-164,
(Order of August 26,
1993 on reconsideration at p.
6 and
cases
cited
therein).
The
Board
will
accordingly
grant
complainant’s motion, but requests
that
we
be
more
timely
notified
of
settlement
negotiations
in
future
cases.
The B.ard’s November 4,
1993
order
is
hereby
vacated.
The
remainder of this order reflects the parties’ stipulated
agreement including complainant’s withdrawal of the alleged
violation of Section 21(p)(2)
of the Act.
This matter originally came before the Board upon a
September
13,
1993 filing of an Administrative Citation pursuant
to
Section
31.1
of
the
Illinois
Environmental
Protection
Act
(Act)
by Sanga.mon County.
A copy
of
that
Administrative
Citation
is attached hereto, but will not be printed in the Board’s
Opinion Volumes.
Service of the Administrative Citation was made
upon Stanley Ray Stewart on September 21,
1993.
Sangamon County
alleges that on August 25, 1993, Stanley Ray
Stewart,
present

owner and/or operator of a facility located in Sangamon County
and commonly known to the Agency as Springfield Township/Stewart,
violated Sections 21(p) (1) and 21(p) (3)
of the Act.
The
statutory penalty established for each of these violations
is
$500.00 pursuant to Section 42(b)(4) of the Act.
Respondent
admits to these violations.
Stanley
Ray Stewart
did
not file a Petition for Review with
the Clerk of the Board within 35 days of the date of service as
allowed by Section 31.1(d) (2) of the Act.
Therefore, pursuant tc
Section 31.1(d) (1), the Board
finds
that
Stanley
Ray Stewart has
violated the provisions alleged in the Administrative Citation.
Since there are two
(2) such violations,
the total penalty to be
imposed is set at $1,000.00.

It is hereby ordered that,
unless the Denaltv has already
been raid, within 30 days of the date of this order Stanley
Ray Stewart shall,
by certified check or money order payable
to the Sangainon County Public Health Department, pay a
penalty in the amount of $1,000.00, which is to be sent to:

Respondents shall include the remittance form and write the
case name and number and their social security or federal
Employer Identification Number on the certified check or

Penalties unpaid after the due date shall accrue interest
pursuant to Section 42(g)
of the Illinois Environmental
Protection Act.

Payment of this penalty does not prevent future prosecution
if
the
violation continues~
Section 41 of the Environmental Protection Act (415 ILCS
5/41
(1992)) provides for appeal of final orders of the Board
within 35 days.
The Rules of the Supreme Court of Illinois
establish filing requirements.
