    ORDER OF THE BOARD (by J. Theodore Meyer):
    This matter is before the Board on a petition for variance,
    filed by Glenbard Wastewater Authority (GWA) on December 22,
    1993. GWA seeks a variance from the effluent disinfection limits
    of 400 per 100 ml daily maximum fecal coliform. Those limits are
    imposed in GWA’s revised NPDES permit #IL0021547. GWA seeks a
    variance for the months of April through October 1994.
    The Board finds the petition deficient. GWA shall file an
    amended petition addressing the following points:
    1. A specific identification of the regulations from which the
    variance is sought. This may include, but may not be
    limited to, 35 Ill. Adm. Code 304.141.
    2. The numerical interim discharge limitations which can be
    achieved during the variance period. GWA has stated that
    numerical limits are difficult to quantify because of the
    variable nature of effluent fecal quantities. GWA should
    elaborate by providing some estimate.
    3. Additional information on the reasons GWA believes that
    compliance would impose an arbitrary or unreasonable
    hardship.
    3. An indication of whether the Board may grant the request
    relief consistent with federal law. (See 35 Ill. Adm. Code
    104. 122 (b)
    .)
    4. A request for hearing, or a statement waiving hearing
    accompanied by an affidavit in support of the material facts
    alleged in the petition. (See 35 Ill. Adm. Code 104.124.)
    GWA is directed to file an amended petition within 45 days
    of
    the
    date of this order, or the petition for variance will be
    subject to dismissal. The Board notes that for purposes of

    calculation of the decision deadline pursuant to Section 38 of
    the Environmental Protection Act, the filing of an amended
    petition will restart the Board’s 120-day decision deadline.
