ORDER OF THE BOARD

On October
18,
1993,
Safety—Kleen filed
a status report
in
accordance with
the Board’s
order
of
September
9,
1993.
The
previous status report filed on September
1,
1993 stated that on
December
11,
1992,
the parties
to this appeal met to discuss a
resolution
of the issues
underlying the above—captioned matter.
During that meeting,
the parties developed
a mutually acceptable
concept as to how to proceed to resolve the appeal issues.
The
report noted that over the past several months,
the parties have
reduced these conceptual understandings to agree
to
language
in
four other closure appeals involving Safety—Kleen facilities,
and
each of these appeals has been voluntarily dismissed.
Safety—Kleen
advised that
the parties
were
now focusing
their
attention on
resolving the instant appeal
in the same manner.
The
present
status
report
states
that
the
parties
have
exchanged comments on a conceptual agreement for resolution.
The
Agency
is
in the process
of
finalizing
and transmitting
those
documents to Safety-Kleen.
Safety-Kleen states that it believes
that this appeal can be resolved within the next forty-five days
and will file further status reports to keep the Board and hearing
officer apprised of the status.
The parties are directed to file an updated status report on
or before December 16,
1993.
