ORDER OF THE BOARD (by R.C. Flemal):
Simultaneous petitioner and respondent briefs in this matter
were due on November 12, 1993. Respondent’s brief was filed
timely; petitioner sought and received leave from the Board to
file its brief by December 1, 1993.
Petitioner now seeks leave, via a motion filed on December
13, 1993, to file its brief instanter. That motion is hereby
granted reluctantly.
It should be noted that petitioner’s brief as filed does not
have pages numbered 11 and 12, and is apparently missing text at
that point. The Board is disinclined to accept a brief that is
incomplete. However, this matter currently has a decision due—
date of January 20, 1994; the Board would appreciate benefit of
petitioner’s full argument, but the decision timeframe is
insufficient for the Board to fully deliberate on this matter and
allow for the filing of a corrected brief. The Board would allow
petitioner opportunity to file a corrected brief only upon filing
of a waiver of the decision deadline.
