This matter is before the Board pursuant to

a

status

report

and

a

motion

for

stay

filed

by

Quantum

Chemical

Corporation,

USI

Division

on

May

17,

1994.

The

status

report

was

filed

in

response

to

our

order of February 17,

1994.

The

status

report

indicates

negotiations

are

proceeding

in related case PCB 93-173,

and

a

joint

status

report

has

been filed that matter.

The report

further

states

Quantum

and

the

Illinois

Environmental

Protection

Agency

(“Agency”)

have arrived at a decision—point in their

negotiations

over

resolution

of

the

permit

appeal

and

further

time

is

needed

for

Quantum

to

obtain

clarification

from

the

Agency

on

its

position

regarding

the

appeal.

The

motion

for

an extension of stay asks for an additional

60 days

in

which

to

negotiate

with

the

Agency

in

order

to

resolve

the permit appeal. Having received no response to the motion from

the Agency, we hereby grant the motion to stay until July 17,

1994.

Quantum is directed to file an additional status report on

or before July 17, 1994,

indicating the status of any on-going

negotiations.

If the negotiations result in the parties agreeing

to pursue PCB 93-173 rather than AS 93-1, Quantum may instead

file a motion to withdraw the petition for an adjusted standard.
