ORDER OF THE BOARD
(by R.C. Flemal):
This matter comes before the Board on a December
17,
1993
amended motion for leave to file an amended petition by Bocker
Chevrolet Company.
On December
2,
1993 the Board denied a
previous motion to file because the actual amended petition was
not filed with the motion,
and as a consequence the amended
petition could not be reviewed by the Board.
The instant motion
is accompanied by the amended petition.
The Board has reviewed
and accepts the amended petition.
The Board notes that
a general consequence of filing an
amended petition in a decision—deadline case is to cause the
decision clock to restart.
In the instant matter, however,
petitioner has filed an open waiver and the decision-deadline
provisions accordingly do not apply.
IT IS SO ORDERED.
I, Dorothy N. Gunn,
Clerk of the Illinois Pollution Control
Bo rd, hereby cerUfy that the above order was adopted on the
