CONCURRING OPINION (by M. Nardulli)
I respectfully concur with the majority’s opinion.
I
believe that Illinois Power has not met its burden of proof in
this proceeding and I support the denial of the adjusted
standard.
However,
I believe that the majority’s opinion
unwisely emphasizes possible future uses and Federal anti-
degradation requirements.
I believe that emphasis detracts from
the well-founded conclusion that Illinois Power has not offered
adequate proof under Section 28.1 of the Act.
