ORDER OF THE BOARD (by M. McFawn):
On November 30, 1999, petitioners filed “Appellants’ Motion to Dismiss,” seeking
dismissal of this appeal without prejudice. The Board grants the motion. This appeal is
dismissed, and the docket is closed.
Although this dismissal is “without prejudice,” the Board notes that, because the time
limit for filing an appeal of the underlying Illinois Environmental Protection Agency decision
has run, the Board would be without jurisdiction to entertain another appeal of that decision.
This order should not be construed as granting petitioners leave to file an untimely appeal.
