CORPORATION FOR AN ADJUSTED

(Adjusted Standard)
STANDARD FROM 35
ILL. ADM.
CODE PART 218 SUBPART TT
)
ORDER OF THE BOARD
(by M. McFawn):
On July 7,
1994 the Illinois Environmental Protection Agency
(Agency)
filed a motion seeking an extension of time in which to
file its response to the petition of Outboard Marine Corporation
(OMC)
for an adjusted standard.
The Agency amended its motion on
July 14,
1994, to request an extension until September 12,
1994.
The Agency response was originally due March 16,
1994.
The
Agency had previously requested an extension until June 14,
1994,
which was granted.
In its motion, the Agency indicates that it needs additional
time to review OMC’s documents in order to provide a well—
informed recommendation.
The Agency also indicates that OMC does
not object to the granting of this extension.
Furthermore, the
Agency indicates that OMC will not suffer prejudice,
since OMC
filed its application for adjusted standard within 20 days of the
effective date of the regulation from which an adjusted standard
is sought, and therefore application of the regulation is stayed
as to ONC
(415 ILCS 5/28.1(e)
(1993)).
The Agency’s motion is hereby granted.
The Agency response
and recommendation must be filed no later than September 12,
1994.
IT IS SO ORDERED.
