On June 2,
1994, Winnebago Reclamation Inc. filed a petition
for an adjusted standard from 35 Iii.
Adm. Code 811.710(c)
and
811.713(c) (1).
The Environmental Protection Act
(Act) (415 ILCS
5/28
(1992)) and the Board’s rules at 35 Ill. Adm. Code 106 set
forth specific procedures to be followed when seeking an adjusted
standard.
Section 28 of the Act requires “within fourteen days
after filing of a petition,
the petitioner shall cause the
publication of a notice by advertisement
in a newspaper of
general circulation in the area likely to be affected.”
Section
106.712 of the Board’s rules requires that “within 30 days after
filing of the petition, the petitioner shall file a certificate
of publication
.

certifying the publication of that notice.”
At this time such certification has not been received by the
Board.
Petitioner is directed to file such certification with
the Board to be received no later than August 19,
1994 or this
petition will be subject to dismissal.
