    On September
    5,
    1991,
    General Motors
    Corporation,
    Electro-
    Motive Division (“GM”) filed a petition for an air variance for its
    facility located in LaGrange, Illinois. On September 15,
    1992, GM
    submitted comments to the U.S.
    EPA regarding
    a proposed federal
    rule applicable to GM’S locomotive coating operations.
    Since that
    time, the parties have been submitting reports to the Board on the
    status
    of this
    case while U.S.EPA considers GM’S comments.
    On
    March 25,
    1994,
    U.S. EPA published the final rule in the federal
    register with an effective date of April
    25,
    1994
    (58
    Fed.
    Reg.
    14110.)
    On May
    16,
    1994,
    petitioner
    filed
    a motion to voluntarily
    dismiss
    the
    petition
    without
    prejudice.
    The motion
    is
    hereby
    granted.
    This matter is dismissed and the docket is hereby closed.
