ORDER OF THE BOARD (by C. A. Manning):
On January 25, 1994, American Tree Service, Inc., (American)
filed a petition for permit review regarding its facility, located
in Sangainon County. The Board set the matter for hearing in its
    order of February 3, 1994.
American, on February 3, 1994, filed an “Amended Notice of
Filing” to change the case caption to reflect that American is
incorporated in the State of Delaware and not the State of
Illinois. The filing makes no substantive changes to the original
    petition filed January 25, 1994.
On February 14, 1994, the Illinois Environmental Protection
Agency (Agency) filed a motion for an extension of time to file its
record in this proceeding. The Agency requests that the Board
extend the filing time until February 16, 1994.
The Board will accept American’s February 3, 1994, filing as
an amended petition to correct the caption of the original petition
and grants said motion. The Clerk of the Pollution Control Board
is directed to correct the caption in this matter to reflect that
American is incorporated in the State of Delaware and that the
decision due date shall run from the filing of the amended
    petition. Since the amended petition has extended the deadline;
the Agency’s motion for an extension of time to file it’s record is
moot. The Agency record is therefore due to be filed on or before
    February 17, 1994.
    IT IS SO ORDERED.
