ORDER OF THE BOARD (by M. McFawn):

This matter is before the Board on a motion to file the

record instanter filed by the Illinois Environmental Protection

Agency (Agency) on July 11, 1994. The petition in this matter

was filed with the Board on May 31, 1994, and the Agency states

that it received notice of the petition on June 2, 1994.

Pursuant to 35 Ill. Adin. Code 105.102(a) (4), the Agency record

is to be filed with the Board within 14 days upon notice of the

petition. The record was therefore due June 16, 1994, and the

Agency’s motion and the record are 25 days late.

Because the Agency’s record is necessary for the decision in

this proceeding, the motion to allow the Agency to file the

record instanter is hereby granted.
