ORDER OF THE BOARD (by C.A. Manning):
On October 27, 1999, the Illinois Environmental Protection Agency (Agency) and
petitioner filed a request for extension of the 35-day appeal period pursuant to Section 40(a)(1)
of the Environmental Protection Act (415 ILCS 5/40(a)(1) (1998)), relating to a September 27,
1999 Agency determination. The final determination concerns petitioner’s site located at 801
North State Street, Freeburg, St. Clair County, Illinois. On December 27, 1999, the Board
received petitioner’s petition for review. The Board accepts this matter for hearing.
Also on December 27, 1999, petitioner filed a motion for corrected caption, requesting
that the caption be corrected by changing the name of petitioner’s name to Freeburg Investors
Group, Inc., the actual owner of the underground storage tanks at issue in this appeal. The
caption in today’s order reflects the proper name of petitioner, Freeburg Investors Group, Inc.
All future pleadings and orders in this matter must reflect this change.
The Board’s rules require that the Agency file the entire Agency record of the permit
application within 14 days of the notice of the petition. See 35 Ill. Adm. Code 105.102.
Hearing must be scheduled and completed in a timely manner, pursuant to the applicable
statutory decision deadline, or the decision deadline as extended by waiver. See 35 Ill. Adm.
    Code 101.105.
Absent any future waivers of the decision deadline, the statutory decision deadline is
now April 25, 2000; the Board meeting immediately preceding the decision deadline is schedule
    for April 20, 2000.

    IT IS SO ORDERED.

the above order was adopted on the 6th day of January 2000 by a vote of 6-0.
