    ORDER OF THE BOARD
    (by C.
    A. Manning):
    This matter is before the Board on an amended petition for
    review filed by the U.S. Department of Army (Department)
    on
    January 19,
    1993.
    The Department had also filed an open waiver
    from the statutory decision deadline on January 26,
    1993.
    The
    Department is requesting the Board to review the Illinois
    Environmental Protection Agency’s
    (Agency) denial of its RCRA
    Part B permit.
    On June 23,
    1994, we directed the parties to file
    a status report in this matter on or before July 15,
    1994.
    On
    July 14,
    1994 the Department filed a status report.
    The status report filed by the Department indicates that the
    parties are attempting to resolve this matter without proceeding
    to hearing.
    The Department stated it will have filed a closure
    plan for its hazardous waste storage facility on July 15,
    1994.
    Upon Agency approval, the Department states that it will close
    its facility and withdraw its RCRA Part B permit.
    The Agency has
    not filed a status report.
    If
    a request for withdrawal of this permit appeal
    is not
    received on or before September 9,
    1994, the parties are directed
    to file,
    jointly or individually, a status report on or before
    that date.
