    On September

    1994, the Illinois Environmental Protection
    Agency
    (Agency) filed a motion to file the record instanter in
    this case.
    Petitioner filed an amended petition in this matter
    on August 4,
    1994,
    and the Agency received notice of the petition
    on August
    5,
    1994.
    The Agency was required to file the record
    within
    14 days of receiving notice of the petition, or by August
    19,
    1994.
    The record was therefore 13 days late.
    The Agency
    states that it believes no prejudice will result from the delay.
    Because the Board must consider the record when rendering a
    decision in this appeal,
    the motion to file instanter is granted.
