ORDER OF THE BOARD (by J. Theodore Meyer):
This matter is before the Board on a motion for
clarification and/or reconsideration, filed on August 30, 1994 by
petitioners. Petitioners ask that the Board clarify and/or
reconsider parts of its August 11, 1994 order. Specifically,
petitioners request that the Board clarify or reconsider whether
it intended to omit the transcripts of the local hearings in PCB
91—7 and PCB 92-25 from the record in this proceeding.
In pertinent part the Board stated in the August 11, 1994
order that:
The request that the Village be allowed, or
required, to separate portions of the record according
to the subject matter of that record is denied.
Although petitioners contend that only the need
criterion is properly at issue, the Board cannot reach
that conclusion at this time. Because we are required
to review the Village’s decision, we must have the
entire record before us. We will, however, allow the
Village to file just the original of the documents in
the record (excluding the transcript). Thus, the
Village shall file seven copies of all transcripts from
the 1994 local hearings, and the original of all other
documents. The Village need not file the transcripts
from the local hearings at issue in PCB 91-7 and PCB
92—25.
The motion for clarification is granted. The Board, in directing
that the Village file only the original documents and “...not
file the transcript from the local hearings at issue in PCB 91—7
and PCB 92-25” in this proceeding, did not intend to state or
imply that the transcripts from the original proceeding are not
part of this record. The Clerk of the Board has these

transcripts on file from the previous proceedings. Since the
records from PCB 91-7 and PCB 92-25 have been incorporated into
this record, those transcripts are part of this record. The
Board only meant to ease the necessary filings by Village.
